1. Agreement
By creating an account or using Konsist (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
Konsist is operated by Konsist (“we,” “us,” “our”) and is available at konsist.xyz.
2. The Service
Konsist is a web-based habit tracking application. We provide tools to create habits, log daily entries, set goals, track progress, and connect with accountability partners.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes.
3. Accounts
- You must be at least 16 years old to create an account.
- You must provide accurate information when registering.
- You are responsible for maintaining the security of your account credentials.
- You must not share your account with others or create multiple accounts.
- You must notify us immediately if you suspect unauthorized access to your account.
4. Free and Pro plans
Konsist offers a free plan and a paid Pro plan.
- Free plan — includes up to 5 habits (yes/no type), basic streaks, and 3 months of history. Free forever, no credit card required.
- Pro plan — includes unlimited habits, all 6 tracking types, accountability rooms, buddy messaging, goals, analytics, and lifetime history. Billed monthly ($4.99/month) or annually ($49.99/year).
5. Payments and billing
- Payments are processed securely by LemonSqueezy. We do not store your payment card details.
- Pro subscriptions renew automatically at the end of each billing period.
- You may cancel your subscription at any time. You retain Pro access until the end of the current billing period.
- We do not offer refunds for partial billing periods. If you cancel mid-cycle, you keep access until the period ends.
- Prices may change with 30 days' notice. Existing subscribers are grandfathered at their current rate until their next renewal.
6. Acceptable use
You agree not to:
- Use the Service for any illegal purpose
- Send spam, harassment, or abusive messages through buddy or room features
- Attempt to access other users' data without authorization
- Reverse engineer, scrape, or interfere with the Service
- Circumvent subscription restrictions or access Pro features without paying
- Upload malicious content or attempt to compromise the Service's security
We reserve the right to suspend or terminate accounts that violate these terms.
7. Your data
- You own your data. We do not claim ownership of your habit entries, goals, notes, or messages.
- You can export your data at any time from your profile settings.
- You can delete your account and all associated data by contacting us at support@konsist.xyz.
- Our handling of your data is governed by our Privacy Policy.
8. Buddy and room features
- Accountability features require mutual consent. You can only follow someone's habits if they invite you.
- You can leave any room or unfollow any habit at any time.
- Messages sent in buddy conversations or rooms are visible to all participants.
- We may remove content or restrict access if it violates our acceptable use policy.
9. Availability and warranties
The Service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted access or that the Service will be error-free.
We make reasonable efforts to keep the Service available and your data safe, but we are not liable for data loss, service interruptions, or damages arising from your use of the Service.
10. Limitation of liability
To the maximum extent permitted by law, Konsist and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
Our total liability for any claim arising from these terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.
11. Termination
You may close your account at any time by contacting us. We may terminate or suspend your account if you violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.
12. Changes to these terms
We may update these terms from time to time. Material changes will be communicated via email or a notice in the app at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
13. Governing law
These terms are governed by the laws of the jurisdiction in which Konsist operates. Any disputes will be resolved through good-faith negotiation first, and if necessary, through the courts of competent jurisdiction.
