1. Agreement
By creating an account or using Konsist (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
Konsist is operated by Allah Bachayo Memon, an individual based in Pakistan. Contact: support@konsist.xyz.
In these terms “Konsist,” “we,” “us” and “our” refer to the Service and its operator. The Service is available at konsist.xyz.
2. The Service
Konsist is a web-based habit tracking application. We provide tools to create habits, log daily entries, set goals, and track progress.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes.
3. Accounts
- You must be at least 16 years old to create an account.
- You must provide accurate information when registering.
- You are responsible for maintaining the security of your account credentials.
- You must not share your account with others or create multiple accounts.
- You must notify us immediately if you suspect unauthorized access to your account.
4. Free and Pro plans
Konsist offers a free plan and a paid Pro plan.
- Free plan: 3 habits of the Yes or No type, 1 open goal, Flex Days, reminders, dark mode and the last 30 days of history. Free for as long as you want it, no card required.
- Pro plan: unlimited habits and goals, all 6 tracking types, your whole history, full export and the Weekly Note. Pro is $3 a month or $12 a year.
- Early access: every new account starts with a period of Pro at no charge. When it ends the account moves to the free plan. Nothing is deleted; habits beyond the free limit stay in your account, with their history, and can be used again on Pro.
5. Billing
- Payments are processed by Lemon Squeezy, which sells Pro as the merchant of record. Your purchase is a contract with Lemon Squeezy, which collects any applicable taxes and issues your receipts and invoices.
- At checkout Lemon Squeezy receives your email address, your payment details and your country. Konsist never sees or stores your card number.
- Konsist stores only the state of your subscription (the plan, whether it is active, cancelled or ended, and the date the current period ends) and the Lemon Squeezy ids of your subscription, customer record and first order, so we know which account is on Pro.
- Pro renews automatically at the end of each monthly or yearly period until you cancel.
- You can cancel at any time from Profile, which takes you to Lemon Squeezy's customer portal for your subscription. You keep Pro until the end of the period you paid for, and then move to the free plan. Updating your payment details works the same way.
- We do not offer refunds for partial billing periods. If you cancel mid-cycle, you keep access until the period ends.
- Prices may change with 30 days' notice. Existing subscribers keep their current price until their next renewal after the notice period.
- Lemon Squeezy handles your payment data under its own privacy policy.
6. Acceptable use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to access other users' data without authorization
- Reverse engineer, scrape, or interfere with the Service
- Circumvent subscription restrictions or access Pro features without paying
- Upload malicious content or attempt to compromise the Service's security
We reserve the right to suspend or terminate accounts that violate these terms.
7. Your data
- You own your data. We do not claim ownership of your habit entries, goals, or notes.
- You can export your data at any time from Profile.
- You can delete your account and all associated data yourself, from Profile.
- Our handling of your data is governed by our Privacy Policy.
8. Availability and warranties
The Service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted access or that the Service will be error-free.
We make reasonable efforts to keep the Service available and your data safe, but we are not liable for data loss, service interruptions, or damages arising from your use of the Service.
9. Limitation of liability
To the maximum extent permitted by law, Konsist and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
Our total liability for any claim arising from these terms or your use of the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.
10. Termination
You may close your account at any time from Profile. We may terminate or suspend your account if you violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.
11. Changes to these terms
We may update these terms from time to time. Material changes will be communicated via email or a notice in the app at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
12. Governing law
These terms are governed by the laws of the jurisdiction in which Konsist operates. Any disputes will be resolved through good-faith negotiation first, and if necessary, through the courts of competent jurisdiction.
